EU Policy and Legislation on Stem Cell Research

Abstract
The current EU policy on research of human embryos and stem cells is based on the 1997 Convention - Convention for the Protection of Human Rights and Dignity of the Human Being with regard to the Application of Biology and Medicine : Convention on Human Rights and Biomedicine. The purpose of this convention is to protect the dignity and identity of all human beings without discrimination while respecting their integrity and any other rights and fundamental freedoms with regard to the application of biology and medicine. Applying this convention¡¯s view to human embryos and stem cells research should regard the following: 1) Human embryo research can only be permitted if it protects the embryo and for the advancement of health and medicine. 2) Synthesis of human embryos is prohibited by any method, such as IVF or SCNT technique. 3) Other stem cell resources (adult stem cell, cord blood stem cell, etc) may be used with full informed consent and without any financial interest of the donor. 4) In all cases, the privacy and human rights as well as the health of all related persons is to be guaranteed. As a result, research on human embryos and stem cells has not been done actively except in a few countries. Now, however, most member states permit stem cell research using spare embryo, but prohibit therapeutic cloning by SCNT. The EU itself, however, has failed to keep its arrangement to fund scientific research on stem cells using spare embryos. It is difficult to say the decision on stem cell research in the future will be made by EU, but EU will continue to stress on the basic human rights, social justice and human freedom in the field of biotechnology and its applications.
